Please read carefully. By creating an account or using HomeDirectNG, you agree to be bound by these Terms of Service. These terms form a legally binding agreement between you and Jerdex Technologies LTD.
1. The Platform
HomeDirectNG is a digital property rental platform operated by Jerdex Technologies LTD, a company incorporated under the laws of the Federal Republic of Nigeria ("Company," "we," "us," or "our").
HomeDirectNG provides a marketplace that connects verified landlords directly with verified tenants through a secure digital infrastructure, including property listings, inspection booking, protected payments, and digital rental agreements.
HomeDirectNG is a technology platform only. We are not a real estate agent, property manager, or party to any rental agreement made between landlords and tenants on the Platform.
2. Eligibility
To use HomeDirectNG, you must:
- Be at least 18 years of age
- Be a resident or citizen of Nigeria, or have legal authority to transact in Nigeria
- Provide accurate, complete, and current information during registration
- Have legal capacity to enter into binding contracts under Nigerian law
- Not be prohibited from using our services under any applicable law
By using the Platform, you represent and warrant that you meet all eligibility requirements.
3. User Accounts
3.1 Registration
You must create an account to access the core features of HomeDirectNG. You agree to provide truthful information and to keep your account details up to date.
3.2 Identity Verification
All users are required to complete identity verification using their National Identification Number (NIN) and a selfie. Verification is conducted through Prembly IdentityPass in partnership with the National Identity Management Commission (NIMC). Unverified users have limited access to Platform features.
3.3 Account Security
You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at enquiry@myhomedirectng.com if you suspect unauthorised access to your account. We are not liable for any loss or damage arising from your failure to protect your credentials.
3.4 One Account Per Person
Each user may maintain only one account. Creating multiple accounts to circumvent restrictions or verification requirements is prohibited and may result in permanent suspension.
4. Landlord Terms
4.1 Listing Requirements
Landlords may list properties on the Platform subject to the following conditions:
- You must be the legal owner of the property or have explicit written authority from the owner to list it
- All listing information, including address, price, photos, and property details, must be accurate and not misleading
- Photos must genuinely represent the property being listed
- The property must be legally habitable and comply with applicable Nigerian building and housing regulations
- NIN verification must be completed before a listing becomes publicly visible
4.2 Landlord Responsibilities
- Respond to inspection requests within a reasonable time (recommended: 48 hours)
- Be present or arrange representation at confirmed inspection appointments
- Ensure the property is accessible and safe for tenant inspections
- Complete the handover confirmation in-app within 48 hours of tenant move-in
- Maintain a valid bank account registered on the Platform for receiving payouts
4.3 Accurate Representation
Fraudulent, misleading, or materially inaccurate listings are strictly prohibited and will result in immediate removal of the listing and suspension of the landlord account, without prejudice to any legal action by affected tenants or by Jerdex Technologies LTD.
5. Tenant Terms
5.1 Tenant Responsibilities
- Attend confirmed inspection appointments punctually
- Conduct yourself respectfully during property inspections
- Make rental payments only through the Platform's secure payment system
- Complete the move-in handover confirmation in-app upon taking possession of the property
- Use the property strictly in accordance with the signed rental agreement
5.2 Off-Platform Payments
Warning: Making or receiving rental payments outside of the HomeDirectNG Platform removes all payment protections and voids any dispute resolution rights. HomeDirectNG bears no liability for transactions conducted outside the Platform.
6. Payments & Payment Protection
6.1 Payment Processing
All payments on HomeDirectNG are processed by Paystack, a licensed payment service provider regulated by the Central Bank of Nigeria (CBN). By making a payment, you agree to Paystack's terms of service in addition to these Terms.
6.2 Payment Protection Mechanism
Upon a tenant making a rental payment, a portion of the rental amount is released to the landlord once the landlord countersigns the rental agreement, provided all required verification has been completed. The remaining portion (the "Holdback") is retained and released to the landlord once move-in has been confirmed, or once the applicable confirmation period (as shown to you in the app at the relevant step) has elapsed without an unresolved dispute. If a dispute is raised before the Holdback is released, the Holdback is frozen pending resolution under Section 12.
6.3 Payout Structure
The standard payout structure is as follows:
- 90% of the rental amount is released to the landlord's verified bank account once the landlord countersigns the rental agreement
- 10% of the rental amount (the "Holdback") is released to the landlord once move-in has been confirmed, or once the applicable confirmation period shown in the app has elapsed without an unresolved dispute
If the landlord does not countersign the agreement within the timeframe shown in the app, the tenant's payment is refunded in full and no disbursement occurs. This structure protects both parties and incentivises a smooth handover process.
6.4 Refunds
Refunds are available in the following circumstances:
- The landlord does not countersign the rental agreement within the timeframe shown in the app, in which case the tenant's full payment is refunded automatically
- The property does not match the listing description in a material way, as determined by HomeDirectNG's dispute resolution process
- A verified fraud or scam is confirmed by our team
If a landlord fails to hand over the property after the 90% has already been released, HomeDirectNG will pursue the matter through our dispute resolution process on the tenant's behalf. This includes collecting evidence from both parties, engaging legal assistance where appropriate, and suspending the landlord's account pending resolution. The 10% Holdback is the portion of funds directly within HomeDirectNG's control and may be released to the tenant as part of this process; HomeDirectNG will take reasonable steps, including legal action where necessary, to pursue recovery of amounts beyond the Holdback on the tenant's behalf, but does not guarantee full recovery of the amount already disbursed to the landlord.
Refund requests must be submitted within the timeframe shown in the app via enquiry@myhomedirectng.com, except where the automatic refund above applies.
6.5 Platform Service Fee
HomeDirectNG charges a service fee on transactions processed through the Platform. The current fee structure is displayed in the app at the time of payment. We reserve the right to update fees with at least 14 days' notice to users.
7. Digital Rental Agreements
HomeDirectNG provides a digital rental agreement feature. By signing an agreement through the Platform, both landlord and tenant acknowledge that:
- The digital signature constitutes a legally binding signature under the Nigerian Evidence Act and applicable e-signature regulations
- The signed agreement is enforceable as a contract between the landlord and tenant
- HomeDirectNG is not a party to the rental agreement and is not responsible for enforcing its terms beyond the scope of the Platform
- Landlords may propose special clauses to include in the rental agreement. Proposed clauses are reviewed by our legal team and approved or rejected by HomeDirectNG based on that review before being included in the agreement presented to the tenant for signature
- Tenants do not propose clauses. Tenants should read the full agreement, including any approved special clauses, before signing
- This review is conducted for compliance with Platform standards only. It does not constitute legal advice, and does not make HomeDirectNG a party to, or a guarantor of, the enforceability of any clause
8. Inspections & Bookings
- Inspection bookings are requests and must be confirmed by the landlord to be valid
- A tenant may book only one inspection per property at a time
- Repeated no-shows by either party may result in account restrictions
- HomeDirectNG is not responsible for the condition of the property during inspection or any injury sustained during an inspection visit
9. Prohibited Conduct
The following activities are strictly prohibited on HomeDirectNG:
- Listing properties you do not own or have no authority to rent
- Creating fake, duplicate, or misleading listings
- Using another person's identity or NIN
- Harassment, threats, or abuse of other users
- Soliciting payments outside the Platform to bypass payment protections
- Using the Platform for any unlawful purpose
- Attempting to reverse-engineer, hack, or disrupt the Platform
- Posting false ratings or reviews
- Discriminating against users on the basis of religion, ethnicity, gender, disability, or any other protected characteristic
Violation of these prohibitions may result in immediate account suspension, permanent banning, and referral to appropriate law enforcement authorities.
10. Platform Fees
HomeDirectNG charges a service charge to facilitate secure, agent-free transactions on the Platform. The rent shown to a tenant is inclusive of this service charge, the price you see is the price you pay, with no separate fees added at checkout. A landlord receives the rent they set when listing, and the service charge applied to that rent is shown to the landlord during listing. Fees are non-refundable except where a transaction is reversed due to fraud or a platform error.
11. Limitation of Liability
To the maximum extent permitted by applicable Nigerian law:
- HomeDirectNG and Jerdex Technologies LTD are not liable for any dispute between landlords and tenants arising from rental agreements
- We are not liable for any loss or damage to property during inspections or tenancy
- We do not guarantee the accuracy of any listing published on the Platform by third-party landlords
- Our total aggregate liability to any user shall not exceed the total fees paid by that user to the Platform in the 12 months preceding the claim
- We are not liable for service interruptions, data loss, or technical failures outside our reasonable control
Nothing in these Terms limits our liability for fraud, gross negligence, or wilful misconduct by Jerdex Technologies LTD.
12. Disputes
12.1 Between Users
HomeDirectNG provides an in-app dispute resolution mechanism. Disputes must be raised within 48 hours of the triggering event. Our team will review evidence from both parties and issue a resolution within 5 business days. Our decision on the release of held funds following a dispute is final.
12.2 Against HomeDirectNG
Any dispute, claim, or controversy arising out of or in connection with these Terms shall first be attempted to be resolved amicably through written notice to enquiry@myhomedirectng.com. If unresolved within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act of Nigeria, with proceedings held in Lagos, Nigeria.
12.3 Governing Law
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
13. Termination
We reserve the right to suspend or permanently terminate your account at our discretion if you violate these Terms, engage in fraudulent activity, or cause harm to other users or the Platform. You may also close your account at any time using the in-app account deletion feature, or by submitting a request at myhomedirectng.com/delete-account.html. Termination does not affect any obligations accrued prior to termination, including outstanding payments or active rental agreements.
14. Changes to Terms
We may revise these Terms from time to time. Material changes will be communicated via in-app notification or email at least 14 days before taking effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform and close your account.
